These Terms & Conditions govern your access to and use of the Site and your purchase of any products through it. By accessing the Site or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Site.

Our collection and use of personal information is described in our Privacy Policy, which forms part of these Terms.

1. Eligibility

You must be at least the age of majority in your province or territory of residence (18 or 19, depending on where you live) to place an order on the Site. By ordering, you represent that you meet this requirement and that any information you provide is accurate and current.

2. Products & Product Information

  • We make reasonable efforts to display our products, ingredients, and descriptions accurately, including Natural Product Numbers (NPNs) and Health Canada–licensed claims where applicable. However, we do not warrant that product descriptions, images, or other content on the Site are error-free, complete, or current.

  • Health information: Statements about our products describe uses and benefits authorized under our Health Canada Natural Health Product licenses. Our products are not intended to diagnose, treat, cure, or prevent any disease. Always read and follow the label and directions for use. Consult a healthcare practitioner before use if you are pregnant, breastfeeding, taking medication, or have a medical condition, and before giving any product to a child.

  • Pricing and errors: All prices are listed in Canadian dollars (CAD) and are subject to change without notice. In the event a product is listed at an incorrect price or with incorrect information due to a typographical, pricing, or other error, we reserve the right to refuse or cancel any order placed for that product, whether or not the order has been confirmed. If your payment method has already been charged and your order is cancelled, we will issue a full refund.

  • We reserve the right to limit the quantity of items purchased per person, per household, or per order.

3. Orders & Payment

  • When you place an order, you’ll have an opportunity to review your cart and correct any errors before submitting payment. Order confirmation does not guarantee product availability; we will notify you if an item you ordered is unavailable.

  • We accept the payment methods displayed at checkout. By providing payment information, you represent that you are authorized to use the payment method provided.

  • Applicable taxes (GST/HST and, where applicable, PST/QST) are calculated based on your shipping address and shown at checkout before you complete your order.

4. Returns & Refunds

Returns, exchanges, and refunds are governed by our Returns & Refunds Policy, which forms part of these Terms.

5. Account Registration 

If you create an account on the Site, you’re responsible for maintaining the confidentiality of your login credentials and for all activity under your account. Notify us immediately at hello@livepurefully.com if you suspect unauthorized use of your account.

6. Acceptable Use

You agree not to:

  • Use the Site for any unlawful purpose or in violation of these Terms;

  • Attempt to gain unauthorized access to the Site, other accounts, or our systems;

  • Interfere with or disrupt the Site’s operation (e.g., via malware, scraping, or automated bots not authorized by us);

  • Post or submit any content (e.g., reviews) that is false, defamatory, infringing, or unlawful;

  • Resell products purchased from the Site for commercial purposes without our prior written consent.

We reserve the right to suspend or terminate your access to the Site if we reasonably believe you have violated these Terms.

7. User Content

If you submit reviews, comments, photos, or other content to the Site or our social media, you grant Purefully a non-exclusive, royalty-free, worldwide, perpetual license to use, reproduce, and display that content in connection with promoting our products and business. You are solely responsible for the content you submit and confirm you have the right to share it.

8. Intellectual Property

All content on the Site — including text, graphics, logos, product names, images, and the “Purefully” brand and trademarks — is owned by or licensed to Purefully Health Inc. and is protected by Canadian and international intellectual property laws. You may not copy, reproduce, distribute, or create derivative works from any part of the Site without our prior written permission.

9. Third-Party Links

The Site may contain links to third-party websites (e.g., social media, payment processors, carriers). We are not responsible for the content, accuracy, or practices of any third-party site, and linking to them does not imply our endorsement.

10. Disclaimer of Warranties

To the extent permitted by applicable law, the Site and all products are provided “as is” and “as available,” without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Nothing in this section is intended to limit any warranty or consumer protection right that cannot be waived under applicable Canadian or provincial law, including protections under provincial consumer protection legislation and the Sale of Goods Act (or equivalent) in your province.

11. Limitation of Liability

To the maximum extent permitted by law, Purefully Health Inc., its directors, officers, employees, and suppliers will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, arising from your use of the Site or our products, even if we have been advised of the possibility of such damages. Our total liability for any claim arising from your order will not exceed the amount you paid for the product giving rise to the claim. This limitation does not apply to liability that cannot be excluded or limited under applicable law (for example, liability for personal injury caused by negligence, or liability that cannot be limited under provincial consumer protection statutes).

12. Indemnification

You agree to indemnify and hold Purefully Health Inc. harmless from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Site.

13. Governing Law & Disputes

These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable therein, without regard to conflict of law principles. Subject to any rights you have under mandatory consumer protection laws of your province of residence (which may give you the right to bring a claim in your home province regardless of this clause), you and Purefully agree to submit to the exclusive jurisdiction of the courts located in British Columbia.

14. Marketing Communications

If you sign up to receive marketing emails or SMS from us, you may unsubscribe at any time using the link or instructions provided in each message. Our marketing communications comply with Canada’s Anti-Spam Legislation (CASL); we only send commercial electronic messages to those who have provided consent.

15. Changes to These Terms

We may update these Terms from time to time. The “Last updated” date at the top of this page reflects the most recent revision. Continued use of the Site after changes are posted constitutes your acceptance of the revised Terms. Material changes affecting an order you’ve already placed will not apply retroactively to that order.

16. Severability

If any provision of these Terms is found to be invalid or unenforceable, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
